Beta Tester Agreement

Compagnon — AI-Powered Culinary Companion

This Beta Tester Agreement ("Agreement") is between 953 LLC, an Arizona limited liability company ("Company"), and you ("Tester").

By checking the "I agree" box and/or accessing the pre-release version of the Compagnon application (the "App"), you agree to the following terms:

1. Pre-Release Software

The Tester acknowledges that the App is a pre-release, beta version that is still under development. The App may contain bugs, errors, and incomplete features. The Company makes no warranties regarding the App's functionality, reliability, or availability.

2. Confidentiality

The Tester agrees to treat the App and all related materials as confidential. Specifically, the Tester shall not:

1. Share screenshots, screen recordings, or videos of the App publicly (social media, blogs, forums, etc.) without prior written consent from the Company;
2. Disclose unreleased features, functionality, or design details to anyone who is not also a participant in the beta test;
3. Reverse engineer, decompile, or attempt to extract the source code of the App.

The Tester may discuss the general concept of the App (e.g., "I'm testing an AI cooking app") without disclosing specifics.

3. Feedback & Intellectual Property

The Tester may provide suggestions, bug reports, feature requests, and other feedback ("Feedback") during the testing period. The Tester agrees that:

1. All Feedback is provided voluntarily and without expectation of compensation;
2. The Company may use, modify, and incorporate any Feedback into the App or its products without restriction, attribution, or payment;
3. The Tester retains no intellectual property rights in any Feedback provided.

4. Data & Privacy

1. The Company may collect usage data, crash reports, and anonymized analytics during the beta period to improve the App;
2. The Tester's personal data (name, email) will be used solely for beta test administration and will not be sold or shared with third parties;
3. Any recipes, cooking notes, or other content created by the Tester in the App remains the Tester's property, but may be lost due to bugs, resets, or the transition from beta to production. The Company is not responsible for data loss during the beta period.

5. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, or consequential damages arising from the Tester's use of the App, including but not limited to data loss, device issues, or reliance on recipe instructions. Use the App at your own risk.

6. Revocation of Access

The Company reserves the right to revoke the Tester's access to the App at any time, for any reason, including but not limited to violation of this Agreement. The Tester may also withdraw from the beta test at any time by uninstalling the App and notifying the Company.

7. Beta Tester Rewards

In consideration for participating in the beta test, the Tester may be eligible for rewards as outlined by the Company (e.g., free premium access upon public launch). Specific reward tiers and eligibility will be communicated separately. Rewards are discretionary and may be modified at the Company's sole discretion.

8. Term

This Agreement is effective from the date of acceptance until the earlier of: (a) the public release of the App, (b) the Tester's withdrawal from the beta program, or (c) revocation of access by the Company. Sections 2, 3, 5, and 6 shall survive termination.

9. Governing Law

This Agreement shall be governed by the laws of the State of Arizona, without regard to its conflicts of law principles.

10. Entire Agreement

This Agreement constitutes the entire agreement between the Company and the Tester regarding beta testing. It supersedes any prior discussions or agreements on this subject. Acceptance via checkbox or continued use of the App constitutes agreement to these terms.
